1. Client Acquisition & Fees
- Artists can either receive client leads (20% fee) or let BuzzHive handle negotiations (15% fee).
- BuzzHive helps secure higher client payouts and provides scam protection.
2. Project Support
- Artists work solo unless collaboration is agreed upon.
- BuzzHive may provide assets, which remain its property unless otherwise stated.
3. Payments & Financial Protections
- Clients pay 50% upfront; artists receive their first payment after the sketch.
- BuzzHive offers limited sellerโs insurance for disputes or chargebacks.
- Payment splits between BuzzHive and the artist are agreed upon before work begins.
4. Rights & Licensing
- Ownership of artwork is clearly defined in each contract.
- Artists may receive royalties if applicable.
- Artists must clarify if work is exclusive to the client or can be resold.
5. Cancellations & Refunds
- Refunds are based on work completed.
- If an artist canโt finish a project, BuzzHive may reassign it, with compensation for completed work.
- Revisions are limited, and extra work may incur additional fees.
6. Dispute Resolution & Liability
- BuzzHive mediates client-artist disputes.
- Artists are responsible for ensuring their work doesnโt infringe copyrights.
7. Privacy Fee
- Clients can pay extra to keep artwork private and off BuzzHive or the artistโs portfolio.
8. Partnership Termination
- Either party can end the partnership at any time for any reason without notice.
- Active projects files must be completed or properly transferred before termination.
9. Confidentiality & Non-Disclosure
- Artists must keep client and business details confidential.
10. Non-Compete & Solicitation
- Artists cannot directly approach BuzzHive clients for personal work for a set period after a project.
11. Rejection & Project Abandonment
- BuzzHive may reject low-quality work.
- Artists abandoning projects without valid reasons may forfeit final payments.
12. Taxes & Legal Responsibilities
- Artists are responsible for handling their own taxes and legal obligations.
13. Communication & Response Times
- Artists must respond in a reasonable timeframe to avoid delays.
14. Amendments & Policy Updates
- BuzzHive may update the terms, with notice given to artists.
Full Agreement
This Agreement governs the relationship between the Artist (โYouโ) and BuzzHive, outlining rights, responsibilities, and financial arrangements.
1. Client Acquisition & Management
1.1 Lead Generation Only
- BuzzHive provides potential client leads; the artist is responsible for communication, pricing, and contracts.
- BuzzHive is not liable for transactions not managed by us.
- Fee: 20% of the project total.
1.2 Full Negotiation
- BuzzHive handles all client communication, including pricing negotiations and contract agreements.
- The artist has the final say before accepting a project.
- Benefits:
- Increased client payouts due to professional negotiation.
- Scam protectionโBuzzHive documents all transaction steps and client details.
- Artists are still compensated if a client cancels midway.
- Fees:
- Client Acquisition Fee: 10%
- Negotiation Fee: 5%
- Total: 15%
2. Project Execution & Collaboration
2.1 Sole Artist Agreement
- The assigned artist is solely responsible for completing the project unless otherwise agreed.
2.2 Team Collaboration
- BuzzHive may offer additional artists for assistance in rare cases.
- Artists are free to decline collaboration offers.
2.3 Asset Provision
- BuzzHive may provide assets (poses, sketches, textures, stock images, templates).
- These assets remain BuzzHiveโs property unless stated otherwise and may only be used for the designated project.
3. Payment & Financial Protections
3.1 Payment Model
- Clients must pay 50% upfront.
- Artists receive their first payment upon completion and approval of the sketch.
3.2 Sellerโs Insurance
- BuzzHive may offer limited protection against chargebacks or disputes.
- Coverage details will be outlined in project contracts.
3.3 Revenue Split Model
- Payment distribution between BuzzHive and the artist will be determined before project commencement.
4. Rights & Licensing
4.1 Studio-Owned vs. Artist-Owned Rights
- Intellectual property rights for each project will be explicitly defined in the agreement.
4.2 Resale & Royalty Agreements
- If applicable, artists may receive royalties from future resales as outlined in separate agreements.
4.3 Exclusive vs. Non-Exclusive Work
- The artist must clarify whether the artwork is exclusive to the client or if it can be resold or reused.
5. Project Termination & Refunds
5.1 Cancellation Policies
- Refund terms depend on the amount of work completed.
- BuzzHive will determine and communicate refund amounts to both the artist and the client.
5.2 Artist Replacement Clause
- If an artist cannot complete a project, BuzzHive reserves the right to assign another artist.
- The original artist will be compensated for completed work if all project files are submitted.
5.3 Revisions & Scope Management
- Revisions are limited to the agreed scope.
- Additional revisions or scope expansions may incur extra fees.
6. Dispute Resolution & Liability
6.1 Dispute Mediation
- BuzzHive will mediate disputes between artists and clients to facilitate resolution.
6.2 Liability Waivers
- The artist is responsible for ensuring their work does not infringe on third-party copyrights or trademarks.
- BuzzHive is not liable for legal claims related to the artistโs work.
7. Privacy Fee
7.1 Confidentiality Option
- Clients can pay an additional fee to prevent their artwork from being displayed by BuzzHive or the artist.
- The privacy fee amount will be discussed and added to the final invoice.
8. Partnership Termination
8.1 Termination by Artist or BuzzHive
- Either party may terminate the partnership at any time with written notice.
- Any active projects must be completed or properly handed over before termination.
- BuzzHive reserves the right to withhold unpaid earnings if an artist breaches contractual obligations.
9. Confidentiality & Non-Disclosure
- Artists agree to keep any non-public project details, client information, and BuzzHive business practices confidential.
- Unauthorized sharing of private client details or internal business practices may result in termination and potential legal action.
10. Non-Compete & Solicitation (Optional but Recommended)
- Artists cannot directly approach or solicit BuzzHive-acquired clients for personal commissions outside of BuzzHive for X months after a project ends.
- Artists may work with previous clients if the client initiates contact and BuzzHive is notified.
11. Rejection & Project Abandonment
- BuzzHive reserves the right to reject an artistโs work if it does not meet agreed quality standards.
- If an artist abandons a project without valid justification, BuzzHive may withhold final payments and reassign the project.
12. Taxes & Legal Responsibilities
- Artists are responsible for handling their own taxes and legal obligations regarding income from BuzzHive projects.
- BuzzHive is not responsible for tax filings, legal compliance, or financial management for individual artists.
13. Communication & Response Times
- Artists must maintain reasonable response times for client interactions and BuzzHive communications.
- Excessive delays without valid reasons (e.g., personal emergency) may result in project reassignment.
14. Amendments & Changes to Terms
- BuzzHive may update these terms as necessary.
- Artists will be notified in advance of any changes, and continued participation implies acceptance.
